MP3 of Puer natus

Hi Peter. This is a somewhat delayed response, but I've just stumbled upon your Puer Natus again and noticed that you've uploaded a non-synthesised MP3 to the CPDL servers. Unfortunately, us admins came to a decision some time ago that we would not allow non-synthesised recordings to be hosted on CPDL because of the potential copyright problems that may arise. Because of this, I'm afraid I've had to delete the file you uploaded. If you're able to upload the file somewhere else and link to that external location from CPDL, we would be happy to let that link stand. Hi, thanks for the very polite and informative message Bob. I totally understand your need to cover your backs on the legal side. I will state however that I played the accompaniment and sang the melody myself, and as far as I know, I have the right to put that recording in the public domain. No doubt you're aware that you may throw the baby out with the bath water on occassions such as this, but that hosting non-synthesized mp3s is an unacceptable risk.

Just out of curiosity :

By synthesized recording, do you mean, synthesized by a sequencer/notation program, never touched by human hands? Or would my interpretation played on my synthesised piano be OK? (I feel I can put information into a recording that Sibelius never could)

And secondly, your whois lists your servers as residing in the US. Are you not protected by the DMCA?

Thanks for your reply, Peter, and thank you for understanding. I hope that nothing I said above suggested that I thought you were acting in bad faith. I am not surprised to learn that you were the sole performer in the recording. You do indeed have the right to place a recording that you made of your own composition into the public domain (except in a couple of jurisdictions but we need not worry about those). By synthesised, I do indeed mean a notation program or other computer program's automatic output of the score without any human contribution which could be considered more than de minimis. I'm sure that any performance you may make would be vastly superior to a computer's interpretation but it is exactly because of this that the admins decided we could not accept non-synthesised recordings (such a recording attracts copyright).
Since CPDL's servers are in the USA, we believe we are protected by the safe harbour provisions of the DMCA. However, as you said, us admins came to our decision because when it comes to recordings, we considered there to be an unacceptable risk involved.
If you wish to challenge or just discuss the current rule on recordings, please feel free to raise the issue on the forums where such a query would reach a larger audience. Best wishes --Bobnotts talk 20:21, 29 June 2010 (UTC)
